From Diagnosis to Lawsuit: Legal Aspects of Medical Liability

On October 7, 2025, a meeting was held at the Department of History of Kazakhstan and Social-Political Sciences for second-year students of the "Medicine" EP in accordance with the fundamental provisions of the President of the Republic of Kazakhstan's Address to the People of Kazakhstan, as well as the department's educational work plan. According to the speaker, this event became necessary as the number of legal actions resulting from medical errors and inaccurate diagnoses continues to rise. The attorney underlined that lawyers frequently deal with cases in which doctors' negligence or disregard result in serious consequences for patients.
Recently, a worrying trend has emerged: doctors are increasingly being attacked by patients' families. This problem has spread and poses a substantial risk to the safety of medical professionals. Such instances occur often and cause concern in the medical community.
The speaker primarily clarified the legal context of liability for medical professionals' violations and provided examples of case law. Special emphasis was placed on criminal penalties for medical malpractice, recognizing indications of health violations, and defining the legal basis for a doctor's criminal prosecution.

Students learned about patients' rights, how to file an appeal against poor quality medical care, professional liability insurance terms for doctors, and the repercussions of improper documentation.
Special attention was given on legal approaches for preventing conflict situations, minimizing legal liability, and advising doctor behavior in difficult situations while providing medical care.
This event sparked a lot of attention among students. Following the lecture-discussion, students engaged in a lively exchange of opinions and asked interesting questions.
Such meetings attempt to increase legal awareness among medical staff, lower the number of offenses, and modify doctors' behavior patterns when interacting with patients.
The facilitators of this event were teachers from the Department: PhD, Associate Professor B.Bitenova, and Assistant Professor D.Y. Dzhakupova from the Department of History of Kazakhstan and Social-Political Sciences.
